Gerstein Justice Building downtown. The bond hearing happens at the Pre-Trial Detention Center within 24 hours of arrest regardless.

Hialeah PD set up a DUI checkpoint on Palm Ave. Can I challenge it?

Yes — and we routinely do. Florida sobriety checkpoints are constitutional only if Hialeah PD followed their written operational plan to the letter: supervisor sign-off, neutral stopping pattern (every nth car), published location, predetermined duration, and a post-operation review. We subpoena the plan and the after-action report on every checkpoint case. Procedural failures are the rule, not the exception.

Will a Hialeah DUI affect my CDL or my ability to drive for Uber/Lyft?

Yes. A CDL holder convicted of any DUI — even in a personal vehicle — faces a one-year CDL disqualification for a first offense and a lifetime disqualification for a second.
